GENERAL RENTAL CONDITIONS

Conditions

These general rental conditions apply to reservations and agreements relating to all our vacation homes. In these general rental conditions, "tenant" means the person who enters into a rental agreement with us regarding the rental of the vacation home.

These terms apply regardless of your (prior) reference to your own terms or to other terms. We reject any terms referred to or used by you.

Deviations from these terms and conditions are only valid if agreed in writing.

Article 1 - Reservations

We only take reservations from persons of 23 years or older. Reservations made by persons under that age are also not valid. We reserve the right to refuse a reservation at any time - without reason.

After you have booked, you will receive a confirmation, the general rental conditions and an invoice from us within one day. The payment of the invoice is subject to the conditions described in article 2.

We request that you check these documents for accuracy and report any inaccuracies to us immediately. If you have not received an acknowledgement of receipt from us within 1 day of making the reservation, please contact us immediately, otherwise you will no longer be able to make a claim on the reservation, which will be cancelled.

A contract between you and us is established when we have confirmed the reservation to you. The agreement concerns the rental of a vacation home for recreational use, which by its nature is of short duration.

Article 2 - Payment

The following conditions apply to payment:

Payments must be made through the website;

When booking the invoice amount must be paid 50% of the rent. The remaining 50% invoice amount must be paid 45 days before arrival.

If you book within 45 days before the arrival date, you must pay the full amount at the time of booking.

Payments should be made by credit card payment or bank transfer on the website of Blue Vibes Bonaire. By making (partial) payment or paying the full rental price, you confirm that you have read and agree to the general terms of rental. The rental agreement ends by law after the expiration of the agreed upon period.

Article 3 - Modifications

If the tenant wishes to make changes to the booking after the booking/agreement has been made, we are not obliged to do so. We are free to choose whether and to what extent changes are accepted. Changes within 4 weeks before arrival are in principle not possible.

If the tenant, after the conclusion of the booking/staying period, changes to a different or non-contiguous/staying period, the cancellation provisions as stated in article 5 apply. A non-contiguous/staying period is in any case understood to mean a period that does not fall within the duration of the stay booked by the tenant (and confirmed by the lessor).

Article 4 - Cancellation

Cancellation by the Hirer must always be made in writing (by e-mail). The following conditions apply:

Partial payments will not be refunded in case of cancellation.

50% of advances paid will be refunded if cancelled 45 days prior to arrival or earlier.

If canceled from 45 days to the day of arrival 100% of the rent due.

If without further notice you have not arrived within 24 hours after the agreed date, this is considered a cancellation and 100% of the rent is due. 

In case of cancellation on our part, already paid amounts to Blue Vibes Bonaire will be refunded. 

Article 5 - Receipt of key.

We make the key of the vacation home available to the tenant on loan. The key remains our property. In case of loss, theft or other loss of the key, the tenant will owe a fee of $25.

All costs incurred due to your failure to return the vacation home on time will be recovered from you. Goods found after your departure will be held for you for a reasonable period of time, but we assume no responsibility for them. Reshipment is only possible at your expense.

If the tenant and/or other users have locked themselves out of the vacation home, a charge of $25 will be made.

Article 6 - Stay in the vacation home

For reservations/stays, the following deadlines and times apply, namely:

On the day of arrival you can in principle use the house from 16:00. On the day of departure you must leave the house before 10:00.

Our vacation homes are non-smoking. Smoking is allowed outside on the terrace.

No open fire is allowed outside.

It is not allowed to bring pets.

The use of water and electricity is included in the price, but we kindly ask you to use them sparingly.

The stay of more persons in the vacation home than agreed upon (at booking), or the maximum that applies to the vacation home, is explicitly not allowed without our permission, unless otherwise agreed upon in writing and will lead to a cancellation of the rental on our part, without refund of the rental price.

Moving cupboards and beds, as well as sound or television equipment or taking any part of the (inside) inventory outside is explicitly not allowed, with the exception of glasses and cutlery for your meal outside.

Article 7 - Force majeure

We speak of force majeure if the implementation of the agreement, whether temporarily or not, is fully or partially prevented by circumstances beyond our control, including war risk, personnel strikes, blockades, fire, floods and other disruptions or events.

Article 8 - Liability / complaints / damage.

Tenant and other users are during the rental period fully and severally liable for all damage caused to the house, the inventory and all belonging to the rented property, unless tenant and other users can show that the damage is not their fault. We therefore advise you to check the inventory on arrival in the vacation home for any defects. If you find any damage or defects, please report this to us immediately.

We do not accept any liability for theft, loss or damage of objects or persons, of any nature whatsoever, during or as a result of the stay in the vacation home.

We accept no liability for work on (main) roads etc. in the vicinity of the house. We accept no liability in the event of failure or malfunction of technical equipment, utilities, or the non-functioning or partial non-functioning of the internet and/or TV.

We will bear the cost of normal maintenance and repair of defects.. If defects occur, the tenant must inform us immediately and follow our instructions as far as possible.

If you nevertheless wish to make a complaint, you must do so in writing and with reasons within 14 days after leaving the vacation home.

Article 9 - Departure and final cleaning

In case of improper use or abandonment of the holidayhome, extra (cleaning) costs can be charged to the tenant.

After the end of the stay, the tenant must:

Leave the house (broom) clean;

Put all dishes clean and dry, back into the cabinets places;

Fold up the bed covers and linen and place them at the foot of the bed;

Leave the dishwasher and refrigerator clean and empty;

Empty the garbage cans; Next to the entrance of the plot is a container for residual waste, in which you can deposit the garbage bags.

Report any breakage and/or damage to the manager.

Article 10 - Applicable law.

The provisions of the Civil Code BES are applicable to all our conditions and provisions of the lease / house rules, and any disputes arising therefrom.
